Please read these Terms of Use carefully before using the Byouma app. By downloading or using the App, you agree to be bound by these terms.
These Terms of Use ("Terms") govern your use of the Byouma mobile application (the "App") operated by Byouma ("we", "us", or "our"). By accessing or using the App, you confirm that you are at least 16 years of age and agree to these Terms in full. If you do not agree, do not use the App.

The App is provided for informational and organisational purposes. It is not a substitute for professional mechanical advice. Always consult a qualified mechanic before making repair or maintenance decisions.
You may sign in using Google Sign-In or Apple Sign-In (iOS only). You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
You agree to provide accurate and up-to-date information about yourself and your vehicles. Inaccurate data will produce inaccurate results — we are not liable for outcomes based on information you provide incorrectly.
You may delete your account at any time by contacting us at dzbyouma@gmail.com. We reserve the right to suspend or terminate accounts that violate these Terms.
The App offers three auto-renewable subscription plans, processed via the Apple App Store:
All prices are displayed in your local currency before purchase. Prices may vary by region.
Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
You can manage or cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until then. No partial refunds are issued for unused portions of a billing period.
Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly.
A free tier is available with limited features, including 7 lifetime AI requests per device. We reserve the right to change the features included in the free tier at any time.
Pro subscribers receive access to expanded features including: 25 AI requests per month, multiple vehicle support, full leaderboard access, all achievement badges, advanced predictive maintenance forecasts, smart price alerts, and profile customisation. Feature availability may change as the App evolves.
The App uses artificial intelligence (xAI Grok) to generate repair cost estimates, failure predictions, modification recommendations, event listings, and chat responses. AI-generated content is provided for informational purposes only and may contain inaccuracies. We do not guarantee the accuracy, completeness, or timeliness of AI-generated information.

You retain ownership of any content you submit to the App (vehicle photos, repair logs, community posts, etc.). By submitting content, you grant Byouma a non-exclusive, royalty-free, worldwide licence to use, display, and process that content solely to provide the App's features and services.
Community posts must be accurate, relevant, and respectful. We reserve the right to remove content that violates these standards or these Terms without notice.
If you enable a public vehicle profile or participate in leaderboards, certain information (vehicle details, health score, reputation score, achievements, and optionally mods and repairs) will be visible to other users. You can control visibility settings at any time in the App.
When you share achievement cards, health scores, or milestone cards outside the App via the share feature, the generated image is shared through your device's native share sheet. We do not control how third-party platforms handle shared content.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the maximum extent permitted by applicable law, Byouma shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or vehicle damage — arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
All content, features, design, code, branding, and materials in the App are owned by or licensed to Byouma and are protected by intellectual property laws. You may not use the Byouma name, logo, or any App content without our prior written permission.

Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party service.
The App may contain links to third-party websites or services (including eBay product listings, YouTube videos, RockAuto, and Google Maps). These links are provided for your convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.
You agree to indemnify, defend, and hold harmless Byouma and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Germany, unless otherwise required by applicable consumer protection law in your jurisdiction.
If you are a consumer residing in the European Union, you also enjoy the protection of the mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and displaying a notice within the App. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
