Terms of Service

Please read these Terms of Service carefully before using the Byouma app. By downloading or using the App, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Byouma mobile application (the "App") operated by Byouma ("we", "us", or "our"). By accessing or using the App, you confirm that you are at least 13 years of age and agree to these Terms in full. If you do not agree, do not use the App.


2. Description of Service

Byouma is a vehicle intelligence platform that provides:

3. Accounts

3.1 Registration

You may sign in using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

3.2 Accurate Information

You agree to provide accurate and up-to-date information about yourself and your vehicles. Inaccurate data will produce inaccurate results — we are not liable for outcomes based on information you provide incorrectly.

3.3 Account Termination

You may delete your account at any time by contacting us at dzbyouma@gmail.com. We reserve the right to suspend or terminate accounts that violate these Terms.


4. Subscriptions and In-App Purchases

4.1 Paid Features

Some features of the App require a paid subscription or one-time purchase, processed via Apple App Store In-App Payments. All prices are displayed in your local currency before purchase.

4.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Your subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period.

4.3 Cancellations and Refunds

You may cancel your subscription at any time through your Apple App Store account settings. Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly.

4.4 Free Tier

A free tier is available with limited features. We reserve the right to change the features included in the free tier at any time.

6.1 Your Content

You retain ownership of any content you submit to the App (vehicle photos, repair logs, community posts, etc.). By submitting content, you grant Byouma a non-exclusive, royalty-free, worldwide licence to use, display, and process that content solely to provide the App's features and services.

6.2 Community Standards

Community posts must be accurate, relevant, and respectful. We reserve the right to remove content that violates these standards or these Terms without notice.

6.3 No Confidential Information

Do not submit confidential information (e.g., VIN numbers used for fraud, personal data of others) through community or public features.


7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

Always consult a qualified mechanic before making any vehicle repair or maintenance decisions. The App is a tool to help you ask better questions, not a replacement for professional advice.


8. Limitation of Liability

To the maximum extent permitted by applicable law, Byouma shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or vehicle damage — arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.


9. Intellectual Property

All content, features, design, code, branding, and materials in the App are owned by or licensed to Byouma and are protected by intellectual property laws. You may not use the Byouma name, logo, or any App content without our prior written permission.


10. Third-Party Services

The App integrates with third-party services including Google Sign-In, Apple Sign-In, Supabase, and AI providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party service.


11. Links and External Content

The App may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.


12. Indemnification

You agree to indemnify, defend, and hold harmless Byouma and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.


13. Governing Law

These Terms are governed by the laws of Algeria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Algeria, unless otherwise required by applicable consumer protection law in your jurisdiction.


14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and displaying a notice within the App. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
